Yesterday, a Kona grand jury indicted 28-year-old Weston Duarte with numerous offenses related to sexual assault and domestic violence incidents that occurred between January and July 2025.
Duarte was charged with 26 offenses, including three counts of Class A felony Sexual Assault in the First Degree, one count of Class A felony Kidnapping, one count of Class B felony Promoting a Dangerous Drug in the Second Degree, one count of Class B felony Obstruction of Justice, three counts of Class C felony Abuse of Family or Household Member, one count of Class C felony Promoting a Dangerous Drug in the Third Degree, one count of Class C felony Intimidating a Witness, one count of Class C felony Terroristic Threatening in the First Degree, one count of Class C felony Unauthorized Control of a Propelled Vehicle in the First Degree, four counts of misdemeanor Abuse of Family or Household Member, one misdemeanor count of Attempted Abuse of Family or Household Member, one misdemeanor count of Terroristic Threatening in the Second Degree, one misdemeanor count of Resisting an Order to Stop a Motor Vehicle in the First Degree, one misdemeanor count of Reckless Endangering in the Second Degree, one misdemeanor count of Negligent Injury in the Second Degree, one petty misdemeanor count of Operating a Vehicle Under the Influence of an Intoxicant, one count of petty misdemeanor Abuse of Family or Household Member, one petty misdemeanor count of Reckless Driving of Vehicle, and one petty misdemeanor count of Driving Without a License.
A Class A felony carries a maximum penalty of a twenty-year prison term; a Class B felony carries a maximum penalty of a ten-year prison term; a Class C felony carries a maximum penalty of a five-year prison term; a misdemeanor carries a maximum penalty of one-year jail; and a petty misdemeanor carries a maximum penalty of 30 days in jail.
Duarte remains in custody in Halawa State Prison on the basis of a pending parole violation; a $350,000 bench warrant has been issued upon the Indictment.
